ARAQUEREYNA strengthens its Administrative, Economic and Regulatory Law Department

As one of the most important steps in the strategic plan of growth and development we have been executing in the last year, we are pleased to announce the addition of Antonio Canova G. and Luis Alfonso Herrera O. as partners of the Firm, and Giuseppe Graterol S. as an associate, who together constituted the team responsible for the Public Law practice area of Bolinaga, Levy, Marquez & Canova.

As a result of these additions to ARAQUEREYNA’s professional team, our Administrative, Economic and Regulatory Law Department is now composed of Partners Gabriel Ruan S., Antonio Canova G., Luis Alfonso Herrera O., and associates Rodrigo Moncho S., Nizar El Fakih E. and Giuseppe Graterol S., with their respective legal assistants. All the referred Partners enjoy high national and international recognition, not only advising clients in their professional practices, but also stand out in the academic field as University professors and prolific contributors to national legal doctrine through manifold publications. In the same sense, the three referred associates are recognized in their respective academic groups as promising leaders in the public and administrative law area. The entire team has extensive experience in amparo, constitutional and contentious-administrative proceedings.

In this manner, our strategic planning reaches a new and very important objective, which joins the other developments that have taken place in the last year, with the addition of María Carolina Cano as Partner of the Tax Law Department; the merger with Aguirre & Moschiano, a Law Firm specializing in labor law and labor safety, deriving in the hiring of Alexis Aguirre and Evelyn Moschiano, as Partner and Associate, respectively, of the Labor Department; and the incorporation of Rafael Aneas R. as Partner of the Litigation Department.

These additions to ARAQUEREYNA’s professional team represent a significant value added that confirms our commitment to provide excellence based legal services, both in Venezuela and globally, forging a solid platform on which we build a proper and orderly growth. Profesional Experience: 

Mr. Canova has gained significant professional experience in the field of the Judiciary in Venezuela. He was reporter and assistant lawyer of the Political and Administrative Chamber and the Plenary Chamber of the former Supreme Court of Justice, as well as reporter of the First Contentious Administrative Court.

In addition, he has stood out as a legal consultant of the Commission of the Supreme Court of Justice for the elaboration of the Constitutional Justice Law and for the preparation of the Constitutional Jurisdiction Bill, in the Supreme Tribunal of Justice.

Mr. Canova has extensive experience in providing legal advice to social programs and to the Municipal Engineering Bureau of the Mayor’s Office of the Chacao Municipality. From 2002 he was the Partner in charge of the Constitutional and Administrative Law Department of the Firm Bolinaga, Levy, Márquez & Canova, where he was regarded as one of the most recognized figures in Public Law in Venezuela, exercising his professional practice before the courts and the Higher Court and providing constant optimal counseling to national and international clients.

He joined ARAQUEREYNA in 2012 as Partner of the Administrative, Economic and Regulatory Law Department.

He has published various legal books and articles, including “Reflections on the reform of the Venezuelan contentious-administrative system”, which was awarded the National Prize of the Academy of Political and Social Sciences in 1997; “The reality of Venezuelan contentious-administrative litigation (A call to attention vis-à-vis the devastating statistics of the Political-Administrative Chamber of the Supreme Tribunal of Justice in 2007 and first half of 2008)”, which was awarded a Special Mention of the same prize in 2009; and his most recent publication: “The Iberoamerican model of Constitutional Justice. Characteristics and originality”, 2012.

Academic Activity: 
Mr. Canova is Professor Instructor at the Faculty of Law of the Andrés Bello Catholic University, and Professor of the Master in Administrative and Procedural Law at the Central University of Venezuela and the Andrés Bello Catholic University. Additionally, he teaches in the Master in Procedural Constitutional Law at the Monteávila University and in the Specialization Course on Human Rights of the Andrés Bello Catholic University.
Memberships & Associations: 
Member of the Venezuelan Association of Administrative Law (AVEDA), Caracas (2001); founder member of the Council of Merit of the Venezuelan Institute of Procedural Law Studies (1998). He formed part of the editorial board of the “Public Law Journal”, published by Editorial Jurídica Venezolana, Caracas (2004) and of the Scientific Advisory Council of the “Administrative Law Journal” and the “Constitutional Law Journal”, in Caracas. Profesional Experience: 

 Mr. Herrera gained significant experience in the Judiciary; he served as a reporter in the First Contentious Administrative Court from 2001 to 2002, and as Lawyer II in the Constitutional Chamber of the Supreme Tribunal of Justice, between 2002 and 2005.

In 2005 he joined the firm Bolinaga, Levy, Márquez & Canova as an associate, where he played an important role in the Constitutional and Administrative Law Department, covering lawsuits of this nature and forming part of the advisory team of prominent private sector companies and municipalities in Venezuela.

He is the author of more than 40 articles published in Venezuelan legal journals and textbooks.

In 2012 Mr. Herrera joined ARAQUEREYNA’s Administrative, Economic and Regulatory Law Department as a Partner.

Academic Activity: 
Professor of Procedural Constitutional and Administrative Law at the Andrés Bello Catholic University, since 2009; and Professor, selected through a public competition process (concurso de oposición), scoring the highest marks, of Administrative Law in the School of Law, Faculty of Law and Political Science at the Central University of Venezuela (since 2008). He has been a Professor of the subjects: “Deepened Administrative Law” and “Case Law Trends and Argumentation in Contentious Administrative Litigation”, in the Master in Administrative Law at the Central University of Venezuela, and Professor of Contentious-Administrative Procedure in the Master in Administrative Law at the Los Andes University, State of Mérida, Venezuela. In 2008, he taught in the Seminar: “Liberalism and Republicanism: two ways of understanding freedom”, in the School of Philosophy at the Faculty of Humanities and Education, Central University of Venezuela.

 With 27 years of proven experience in Venezuela and keeping the city of Caracas as its base of operations, ARAQUEREYNA announced the opening of its offices in the industrial city of Valencia, Carabobo State, as part of its strategic project of national expansion. This will represent a major geographical coverage for its capacity to assist clients, while maintaining the same levels of professional excellence guiding its professional activity.

Lawyers David Sanoja, Rosario Lai and Juan Aranda are the partners leading the Valencia office, whose practice is based in a cohesive team consisting of four associate attorneys, who are outstanding for their high academic performance, and have a clear recognition and experience in the Carabobo State and the central region.

David Sanoja is an attorney graduated from Universidad Católica Andrés Bello and specialized in labor law at the same university. He has taken Negotiation studies at the Instituto de Estudios Superiores de Administración (IESA), and has been Labor Legal Consultant to the Venezuelan Association of Five-Star Hotels (AVECINTEL). He also served as an Associate Judge of the Sixth Court of First Instance in Labor Matters of the Judicial Circuit of the Caracas Metropolitan Area (1998) and of the First Superior Court in Labor Matters of the same circuit. He has also been a guest lecturer at IESA, on the subjects of Labor Legislation, Collective Bargaining Agreements and Negotiation in Conflicting Environments.

For her part, Rosario Lai is an attorney graduated with highest honors (summa cum laude) from Universidad Arturo Michelena, and specialized in Procedural Labor Law at the same university. She earned a Master’s Degree in Labor Law from the University of Carabobo. She shares her professional practice with teaching, being a professor at the University of Carabobo and Universidad José Antonio Páez.

Juan Aranda is an attorney graduated from Universidad Católica Andrés Bello. He is Legal Counsel to the Association of Executives of Carabobo State (AEEC), and has worked as Legal Consultant to Ford Motor de Venezuela and Unilever Andina Venezuela, S.A. “The formalization of this merger process, which we are sure will strengthen our leadership in the national market, will allow us to offer a more comprehensive and specialized service to our clients”, said David Sanoja about the alliance.

Profesional Experience: 

 Mr. Sanoja has focused his professional practice on advising companies engaged in the insurance, hotel, capital markets, services, banking, multiple ownership and timeshare, communications, tourism, mass consumption products, and industry activities, among others; as well as on the planning of Mergers and Acquisitions.

He served for ten years as an associate attorney at the Law Firm of Villalba & Asociados, in Valencia, Carabobo State, and for seven years at the Law Firm of Calcaño-Vetancourt, in Caracas. He was a Legal Consultant to the Venezuelan Association of Five-Star Hotels (AVECINTEL) between 1992 and 1999.

In 2009, Mr. Sanoja established Sanoja Lai & Asociados in Valencia.

He served as an Associate Judge of the Sixth Court of First Instance in Labor Matters of the Judicial Circuit of the Caracas Metropolitan Area in 1998, and of the First Superior Court in Labor Matters in the same judicial circuit.

He collaborated on the drafting of the Integrated Social Security System Bill in 1999; he was involved as a guest and a participant in the Round of Discussions on the Health Subsystem and Labor Risks, and also worked on the drafting of the Bill on the Health Subsystem, Prevention Regime and Workplace Risks.

Academic Activity: 
Since 2006, Mr. Sanoja serves as a guest professor at the Instituto de Estudios Superiores de Administración (IESA), in the Caracas, Valencia and Maracaibo branches, on the subjects of Labor Legislation, Collective Bargaining and Negotiation in Conflicting Environments. He was an assistant professor of Labor Legislation at the Faculty of Economics of the Santa María University, between 1997 and 1998. He has also been a professor of Labor Procedural Law of the Department of Postgraduate Studies at that university. He has taken part as a speaker and assistant professor in various forums and workshops, including the Forensic Updating Workshops on the new Organic Procedural Labor Law at the Forensic Training Center “Dr. Luis Loreto” of the Juridical Studies Institute of the Carabobo Bar Association. He also participated in the European Conference (Malta, 2005) and the Latin American Regional Conference (Montevideo, 2005) of the Geneva Group International (GGI).

She has also focused her practice on the incorporation and registration of companies.

Academic Activity: 
Ms. Lai teaches Mining, Oil and Environmental Law at the University of Carabobo since 2008, and Human Rights at the José Antonio Páez University since 2007. She was a member of the Organizing Committee of the I Conference of Constitutional Law at the Arturo Michelena University in 2006. New rate for trademarks and patents applications in Venezuela

Since September 11 of this year, applications for registration of trademarks, advertising slogans, trade names, invention patents, industrial designs and improvements must be accompanied with a 10 tax unit (T.U.) tax stamp. Therefore, in addition to the fees normally charged, applicants must pay for the application for a trademark or patent the amount of Bs. 1,070 (US$ 169.84), equivalent to this date to 10 T.U.

The foregoing in accordance with the Official Announcement issued by the Autonomous Intellectual Property Service (SAPI) last September 11, in accordance with the Special Tax Stamp Law for the Capital District.

Thus, for the application of a trademark, advertising slogan, trade name, invention patent, industrial designs and improvements, the applicant shall pay:

  •  Application fee provided for in the Industrial Property Law: 0.1 T.U., equivalent to Bs. 10.70 (US$ 1.69).
  •  Application fee provided for in the Special Tax Stamp Law for the Capital District: 10 T.U., equivalent to Bs. 1,070 (US$ 169.84).
  •  National Tax Stamp: 0.02 T.U., equivalent to Bs. 2.14 (US$ 0.33).
  •   Form FM02 (trademarks) or FP-01 (patents): Bs. 69 (US$ 10.95).
  •   Folder: Bs. 57 (US$ 9.04).
